Terms of Service

The following terms and conditions (hereinafter referred to as the “T&Cs”) govern the relationship between users/visitors and UnitedGambling.org (hereinafter referred to as the “Website”).

 

1. General Provisions

 

1. By accessing or using the Website, users/visitors agree to be bound by these T&Cs. If there is disagreement with any of the provisions set out in the T&Cs immediately of Website usage and the Services is required.

  • 1.1 United Gambling is not an online casino or a casino provider therefore it does not allow users/visitors to gamble, place bets or wagers on the Website. United Gambling does not provide legal advice. The information on the Website as well as any articles published on it must not be considered as a substitute for legal advice. 
  • 1.2 BY AGREEING TO THESE T&CS USERS/VISITORS WAIVE THEIR RIGHTS TO PARTICIPATE IN CLASS ACTION OR JURY TRIAL AGAINST UNITED GAMBLING IN JURISDICTIONS WHERE SUCH WAIVERS ARE POSSIBLE AND AGREE TO SUBMIT TO ARBITRATION. 
      • The privacy policy should be carefully reviewed (accessible here and hereinafter referred to as the “Privacy Policy”) before using the Website or the Services (defined below). Non agreement with the terms of the Privacy Policy necessitates immediate discontinuation of the Website and Services usage.
      • The operation of the Website is managed by UG Holdings Ltd a company incorporated in Malta, with company registration number C95226 and its registered address at 62, Regent House, Bisazza Street, Sliema SLM 1640, Malta (hereinafter referred to as “United Gambling”, “we”, “our”, or “us”). 
      • Throughout these T&Cs, the terms “user” “visitor” or “player” refer to any individual/physical person who accesses or uses the Website or the Services, as defined in these T&Cs. 
      • In these T&Cs, words importing the singular include the plural and vice versa, and words importing gender include all genders.

2. Provision of Services

 

2.1 The Website provides the users with information about sweepstakes casinos, social casinos, real money casinos, casino games, poker, blackjack, promotions, rankings, bonuses, welcome offers, casino providers and the gambling industry in general, as well as casino news (hereinafter referred to as the “Services”).

2.2 United Gambling does not provide any gambling on the Website.

2.3 The Services are intended for informational purposes only and exclusively intended for users or visitors in jurisdictions where their use is legal. Compliance with the laws, regulations, and directives applicable to the usage of the Website and the services in the user/visitor’s location is mandatory by any user/visitor.

  7. That they understand and acknowledge the risks associated with gaming and gambling activities and have no claims against United Gambling, its licensors or its affiliates regarding gambling losses; 
  8. That the use of the Website and of the Services is entirely optional and at their own risk.

2.5 United Gambling does not provide legal advice on the legality of gambling, and it is the users/visitors’ responsibility to understand the gambling laws in their State jurisdiction.

 

3. LIMITATIONS OF USE / LEGAL AGE

 

3.1 The Website, the Services and any material displayed therein are not intended for users who are not of legal age in their own jurisdiction. Legal age may vary according to the jurisdiction/US State of residence and according to the game type; users/visitors must ensure compliance with the relevant age restrictions. Notwithstanding the above, users/visitors below the age of 18 shall not use the Website and the Services in any capacity.

 

4. REPRESENTATIONS

 

4. By using the Website, users/visitors represent and warrant:

  • That they are of legal age in their State of residency and that they use the Website and the Services according to the limitations set out for each game in such State; 
  • That they use the Website in accordance with these T&Cs and not engage in illegal or unauthorized activities;
  • That they use the Website and Services for personal purposes only; 
  • That usage of the Website and Services complies with the laws and regulations of their State of residency.

5. INTELLECTUAL PROPERTY

 

5.1 United Gambling, its affiliates, and its licensors own all software, data, written materials, and any other content, including but not limited to logos, graphics, artwork, images, videos, and text, available on or through the Website (hereinafter referred to as the “UG Content”). Removal or infringement of any copyright or proprietary notice on the Website or the UG Content is prohibited. 

5.2 The Website also contains hyperlinks to third party websites, services, products, brands, trademarks and/or content (hereinafter referred to as “Third Party Content”). United Gambling is not responsible for any Third Party Content and does not guarantee its accuracy and quality. All the Third Party Content made available/displayed on the Website is owned by the respective third parties directly or through their affiliates or licensors and these retain all rights to such Third Party Content. Users/visitors shall not infringe or exploit the Third Party Content or any other intellectual property present on the Website. 

5.3 Users/visitors are solely responsible for their use of any Third Party Content,  at their own risk.

5.4 By using the Services or visiting the Website, users/visitors do not acquire any rights in the UG Content and the Third Party Content.

 

6. CONTENT CREATED BY USERS

 

6.1 Users/visitors are expected to interact politely with other users/visitors Website and must avoid engaging in any inappropriate, indecent, insulative or bullying behaviour.

6.2 It is strictly prohibited to transmit, upload, post, or make available User Content (as defined below) or any other content that violates any applicable laws, incites violence, infringes intellectual property rights, promotes unlawful activity, or is harmful or offensive.

6.3 United Gambling might permit users to transmit, upload, post, email, or otherwise make available posts, comments, articles, data, text, software, music, images, videos, messages, or other materials (hereinafter the “User Content”) on the Website. Users/visitors are solely responsible for User Content, and United Gambling and its affiliates or its licensors have no liability concerning it. By providing User Content, users/visitors grant United Gambling, its affiliates and its licensors a perpetual, irrevocable, transferable, worldwide license to use, copy, distribute, sub-license, reproduce, display, modify, create derivative works, and more based on the User Content for various purposes, including promotion and advertising. Users/visitors waive all moral rights to the User Content and acknowledge that United Gambling, its affiliates and its licensors are not obligated to monitor or review User Content.

6.4 United Gambling may edit or remove User Content as deemed appropriate.

6.5 Personally identifiable information submitted by users/visitors may be read, collected, or used by other users, visitors, or third parties. United Gambling and its affiliates are not responsible for any personally identifiable information or User Content users/visitors choose to submit.

 

7. PROHIBITED USE

 

7.1 When accessing and using the Website, users/visitors agree not to:

  1. Damage the reputation of United Gambling;
  2. Distribute malicious code, viruses, or any other harmful content to the Website; 
  3. Attempt to access or gather personally identifiable information of other users/visitors; 
  4. Engage in activities such as copying, redistributing, reverse engineering, modifying, or creating derivative works based on UG Content, Third Party Content, or User Content;
  5. Disclose Website-related data to third parties;
  6. Use the Website, the Services, the UG Content, Third Party Content, or User Content for unlawful activities; 
  7. Alter, lease, copy, distribute, display, reproduce, publish, license, or sell any UG Content, Third Party Content, or User Content; and
  8. Collect data from the Website or employ any automated methods to access it. 

8. DISCLAIMER

 

8.1 Users/visitors access to and use of the website and of the services are at their sole discretion and risk. the website, services, and materials are provided on an “as is” basis. united gambling, its affiliates, and licensors disclaim all warranties and conditions, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, satisfactory quality, and accuracy.

8.2 United gambling makes no warranty that the website, services, or materials will meet user/visitor’s requirements, be uninterrupted, secure, or error-free, or free of viruses, malware, or bugs.

8.3 United gambling is not responsible for offers, guarantees, or services offered or provided by casino operators and other third parties on the website after leaving the website.

 

9. LIMITATION OF LIABILITY 

 

9.1 United gambling, its affiliates, and/or licensors shall not be liable in contract, tort, negligence, or otherwise for any loss or damage arising from or related to users/visitors’ use or access of the website or the services, whether direct or indirect, including but not limited to business loss, loss of profits, business interruption, loss of business information, or any other consequential loss. united gambling is not liable for the content on any linked internet website or casino operator.

9.2 United gambling shall not be liable for any modification, suspension, or discontinuance of the website or services.

 

10. INDEMNIFICATIONS 

 

10.1 By using the website or services, users/visitors agree to indemnify and hold united gambling, its officers, directors, employees, agents, affiliates, licensors, and suppliers (herein after collectively, the “indemnified parties”) harmless from and against any and all claims, liabilities, damages, losses, fines, costs, and expenses, including legal fees, arising, directly or indirectly from:

  1. any breach of these t&cs; 
  2. access and use of the website or services; 
  3. violation of any law, regulation or directive; 
  4. negligence or willful misconduct.

10.2 Users/visitors agree to promptly notify united gambling of any claims and not settle any claim without united gambling’s consent. the indemnified parties may assume the defense of any claim, and users/visitors shall cooperate with reasonable requests for information and assistance. users/visitors may employ separate counsel for claims and participate in their defense.

 

11. TERMINATION 

11.1 United Gambling may terminate these T&Cs and user access to the Website and Services without notice if:

  1. Breach or suspect of breach of these T&Cs occurs:
  2. Prohibited use pursuant to Section 7 takes place
  3. Violation of any law, regulation, statute or directive applicable to user/visitor access and use of the Website or the Services happens; 
  4. United Gambling reasonably believe that user/visitor’s use of the Website or of the Services damages United Gambling, other users/visitors, or third parties.

11.2 Users/visitors acknowledge that violating these T&Cs could significantly harm United Gambling, and equitable remedies, such as specific performance and injunctive relief, might be sought without requiring proof of specific damages.

11.3 Sections 5, 6, 7, 8.3, 9, 10, 13 and 17 of these T&Cs shall survive and remain in effect even after termination or expiry of these T&Cs. 

 

12. CHANGES IN T&Cs

 

12.1 Disagreement with any terms or conditions in this T&Cs, requires immediate cessation of Website and Services usage. United Gambling reserves the right to amend these T&Cs periodically, with such changes becoming effective one (1) day after publication on the Website or earlier if required by applicable laws, regulations, or directives. Users/visitors’ continued access to the Website and/or use of the Services implies their acceptance of the revised T&Cs. Users/visitors are responsible for staying informed of the latest terms and conditions by regularly review the T&Cs and the Privacy Policy.

12.2 United Gambling retains discretion to terminate or suspend users/visitors access to the Website and to the Services, without any financial compensation to users/visitors at its sole discretion and for any reason, including but not limited to breach of these T&Cs.

 

13. SEVERABILITY

 

13.1 If any provision of this T&Cs is found invalid, the remaining provisions shall remain valid and unaffected.

 

14. MISCELLANEOUS

 

14.1 No waiver by United Gambling of any terms of the T&Cs shall be construed as a waiver of any subsequent breach.

14.2 These T&Cs do not create any rights or benefits for third parties nor do establish an agency, partnership, trust arrangement, fiduciary relationship, or joint enterprise.

 

15. ASSIGNMENT

 

15.1 United Gambling reserves the right to transfer, assign, sublicense, or pledge these T&Cs, in whole or in part, without user/visitor’s consent, to entities within the same corporate group as the United Gambling or to third parties in the event of corporate transactions. Users/visitors may not transfer or assign their rights or obligations under these T&Cs in any manner.

 

16. ENTIRE AGREEMENT

 

16.1 These T&Cs constitutes the entire agreement between users/visitors and United Gambling and replace and supersede any prior T&Cs related to the users/visitors’ use of the Website and Services. Users/visitors acknowledge that they have not relied on any warranties or representations other than those expressly made by United Gambling in these T&Cs.

 

17. GOVERNING LAW AND JURISDICTION

 

17.1 These T&Cs and user/visitor’s use of the Website and Services are governed by the laws of Malta, without regard to conflict of law provisions. Any dispute or claim related or in any way connected with these T&C, the Website or the Services shall be subject to the exclusive jurisdiction of the Maltese Courts.
